## Overview

Welcome to Trove of Collectibles. The terms “we,” “us,” and “our” refer to Trove of Collectibles. Trove of Collectibles operates this store and website, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience (the “Services”). Trove of Collectibles is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with all policies and rules incorporated by reference (collectively, the “Terms”), describe the rights and responsibilities that apply when a person visits, interacts with, or uses the Services.

By accessing or using the Services, creating an account, submitting information, placing an order, using a buylist or promotional feature, or selecting a policy-acceptance checkbox, you agree to these Terms, our [Privacy Policy](https://troveofcollectibles.com/policies/privacy-policy), our [Trove Supplemental Privacy Notice](https://troveofcollectibles.com/pages/trove-supplemental-privacy-notice), and our [Return, Refund, Promotional Points, and Claims Policy](https://troveofcollectibles.com/policies/refund-policy). If you do not agree, you must not use the Services.

Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded or limited.

## Section 1 — Access, Age, and Account Security

You represent that you are at least the age of majority in your state, province, or country of residence. A minor may use the Services only with the involvement and authorization of a parent or legal guardian when required by law or Trove policy. A person using a purchasing, selling, payout, store-credit, or other transactional feature must have legal authority to complete that transaction.

You must provide correct, current, complete, and authorized information. You must not impersonate another person, use another person’s payment method or account without authorization, create accounts to evade restrictions, or provide information you have no right to provide.

You are responsible for protecting your credentials and for activity performed through your account. You must not share, transfer, sell, assign, license, or permit another person to use your account or administrative access. You must notify Trove promptly if you suspect unauthorized access or misuse.

We may require identity, account, payment, address, eligibility, or ownership verification before allowing a transaction or account action. We may restrict, suspend, or terminate access when information cannot be verified or when reasonably necessary to protect the Services, customers, employees, or others.

## Section 2 — Products, Collectibles, and Product Information

We make reasonable efforts to present products accurately. Colors and appearance may vary because of device displays, lighting, photography, printing variations, manufacturing variations, and product condition.

Collectible-card condition is inherently subjective. Product descriptions, photographs, condition labels, estimated values, and grading-related information do not guarantee a particular professional grade, market value, future value, centering, print quality, or customer opinion.

Product descriptions, availability, specifications, release information, prices, promotions, and purchase requirements may be corrected or updated. We may discontinue products and limit quantities by customer, account, household, address, payment method, geographic area, event, or other reasonably related criterion, subject to applicable law.

Images, game rules, card text, characters, trademarks, and other third-party materials remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.

## Section 3 — Orders, Acceptance, and Final Review

Submitting an order is an offer to purchase. Checkout completion, payment authorization, promotional-credit display, inventory display, and an automated order confirmation acknowledge receipt of the order only; they do not guarantee acceptance, allocation, or fulfillment.

An order is accepted only when Trove expressly confirms acceptance or begins fulfillment, subject to rights that applicable law requires to remain available.

Before fulfillment, Trove may review, limit, correct, reject, or cancel all or part of an order when:

- Purchase limits, promotional requirements, or eligibility requirements are not satisfied;
- A price, discount, promotional credit, quantity, inventory status, shipping charge, tax result, or other checkout result was displayed or applied incorrectly;
- Suspected resale, scalping, fraud, abuse, manipulation, duplicate-account activity, or policy circumvention is identified;
- Required customer, account, payment, address, or purchase information is missing, inaccurate, inconsistent, unauthorized, or cannot be verified;
- A manufacturer, publisher, or distributor allocation is delayed, reduced, canceled, or differs from the quantity expected;
- Product availability, release information, purchase requirements, or promotional terms change; or
- Fulfillment becomes inappropriate or impossible for another legitimate business reason permitted by applicable law.

A website, application, checkout, promotional-credit, pricing, inventory, automation, or staff error does not make an otherwise invalid or ineligible price, credit, quantity, promotion, or purchase valid.

Trove will not increase the amount charged for an order without authorization. If merchandise will not be fulfilled, Trove will provide the notice, cancellation option, refund, or other remedy required by applicable law. When applicable, valid store credit used on a canceled item will be restored.

You must review an order carefully before submitting it. Customer-requested cancellation remains subject to the Return, Refund, Promotional Points, and Claims Policy and cannot be guaranteed after processing or fulfillment begins.

## Section 4 — Purchase Limits, Resale, Scalping, and Promotions

Products or promotions identified as limited, allocated, restricted, event-exclusive, customer-exclusive, household-limited, or intended for personal use must comply with every displayed eligibility and quantity requirement.

You must not divide purchases among multiple accounts, names, addresses, payment methods, devices, or other means to evade a restriction. You must not use automated purchasing tools, bots, deceptive information, collusion, or another person’s account to obtain restricted merchandise or promotional benefits.

When a promotion awards points or credit that unlocks another product, the earning products and unlocked products form one connected promotional transaction. Promotional points have no cash value, are nontransferable unless Trove expressly permits a transfer, and may be reversed when created, displayed, or used in error. Removing, canceling, returning, or making an earning product ineligible may also make an unlocked product ineligible.

Specific promotion terms control if they expressly conflict with these general Terms, except that an error does not create eligibility that the stated promotion did not provide.

## Section 5 — Preorders, Backorders, and Allocations

Preorders and backorders do not guarantee that Trove will receive any particular product or quantity. Manufacturers, publishers, and distributors may delay, reduce, change, or cancel allocations, and Trove may receive fewer units than expected or no units.

Before fulfillment, Trove may reduce quantities, allocate limited supply among eligible orders, enforce purchase limits, or cancel affected merchandise. Allocation methods will be applied consistently to similarly situated orders.

If Trove cannot ship within a promised time or another time required by law, Trove will provide the customer with any legally required delay notice, opportunity to consent to the delay, cancellation option, and prompt refund. Trove will not substitute materially different merchandise without the customer’s agreement when consent is required.

## Section 6 — Prices, Payment, Billing, and Store Credit

Prices, promotions, and discounts may change before an order is submitted. Unless expressly stated otherwise, prices exclude taxes, shipping, handling, customs duties, import charges, and other legally applicable charges.

You must provide complete, current, accurate, and authorized payment and account information. You represent that you are authorized to use the payment method provided and that charges properly incurred will be honored.

Prices offered online, in a physical store, through a marketplace, through a buylist, or by another seller may differ. Market prices and collectible values fluctuate, and Trove does not guarantee future price, resale value, or liquidity.

Store credit and promotional credit are not bank deposits, cannot be redeemed for cash except when required by law or expressly stated by Trove, and may be subject to separate disclosed conditions. Trove may correct or reverse an unused balance that was created, duplicated, transferred, or applied in error. Completed lawful transactions and nonwaivable rights remain unaffected.

## Section 7 — Shipping, Delivery, Risk, and Claims

Delivery dates are estimates unless Trove expressly guarantees a date. Trove is not responsible for delays caused by carriers, customs, weather, disasters, government action, labor interruption, manufacturer delay, incorrect customer information, or other events outside Trove’s reasonable control, but Trove will provide any notice, cancellation option, refund, or remedy required by applicable law.

Title and risk of loss transfer as provided by applicable law and the selected delivery arrangement. Nothing in these Terms eliminates responsibility that applicable law places on Trove for nondelivery, shipping damage, inaccurate fulfillment, or another verified claim.

All damage, tampering, missing-item, incorrect-item, condition, and nondelivery claims are governed by the deadlines, packaging-retention duties, and continuous-opening-video requirements in the [Return, Refund, Promotional Points, and Claims Policy](https://troveofcollectibles.com/policies/refund-policy). Customers must comply with those requirements except where applicable law requires otherwise.

## Section 8 — Returns, Refunds, Exchanges, and Charge Disputes

Returns, refunds, exchanges, promotional-point reversals, shipping claims, and opening-video evidence are governed by the [Return, Refund, Promotional Points, and Claims Policy](https://troveofcollectibles.com/policies/refund-policy), which is incorporated into these Terms.

Customers must provide truthful and complete claim information and must not substitute, alter, damage, misrepresent, or falsely identify an item or package. Fraudulent returns, switched merchandise, fabricated damage, false nonreceipt claims, altered evidence, and abusive payment disputes are prohibited and may result in denial of the claim, account restriction, recovery activity, or referral to payment providers or authorities as permitted by law.

Nothing in these Terms prevents a customer from exercising lawful payment-dispute, warranty, or consumer-protection rights. A customer initiating a dispute must provide truthful information and cooperate with lawful requests for evidence.

## Section 9 — Sell to Us and Buylist Services

A buylist search result or quote is an estimate and not a binding purchase offer. Final eligibility, identity, authenticity, ownership, condition, quantity, price, payout method, and acceptance are determined after Trove receives and reviews the cards.

A seller represents that the seller owns the submitted items, has authority to sell them, and is not submitting stolen, counterfeit, altered, unlawfully obtained, or fraudulently described property. A seller must disclose known alterations, damage, authenticity concerns, or ownership disputes.

Organized-play and local-event cards identified as ineligible under the current buylist rules will receive no offer unless an authorized Trove manager corrects a mistaken classification. A system error displaying an offer for an ineligible card does not obligate Trove to purchase it.

Trove may reject cards based on condition, authenticity, inventory levels, current demand, pricing availability, legal restrictions, suspected fraud, or other published buylist rules. An emailed offer does not mean payment has been issued. Payment or store credit is completed only after the seller accepts the reviewed offer and an authorized employee records completion.

Mail-in sellers are responsible for complying with packing and shipping instructions. Trove is not responsible for items lost or damaged before delivery to Trove except to the extent required by law. Buylist records and employee actions are handled as described in the Privacy Policy and Trove Supplemental Privacy Notice.

## Section 10 — Smart Search, Deck Lists, AI, and Catalog Information

Smart Search, deck matching, recommendations, rules references, pricing information, image analysis, and AI-assisted outputs are informational tools. Results may be incomplete, inaccurate, outdated, unavailable, or based on limited catalog data. They do not guarantee card legality, tournament eligibility, deck performance, compatibility, availability, condition, value, or price.

Users must independently verify official game rules, tournament documents, rotation requirements, card text, legality, and event requirements before relying on a result. Official publisher and tournament-organizer materials control over Trove-generated summaries or recommendations.

You must not submit confidential information, account passwords, complete payment credentials, government identifiers, private communications, or unnecessary personal information through a search field, deck list, upload, or AI-assisted feature.

You must not use automated requests, scraping, reverse engineering, prompt injection, malicious files, excessive traffic, or another method intended to extract protected data, bypass limits, disrupt a service, or manipulate results.

## Section 11 — Community, Event, Deck, Image, and Profile Submissions

If you voluntarily submit a deck list, event result, photograph, display name, social-media handle, testimonial, review, or other material for publication, you represent that you own the submission or have all permissions required to provide it and permit its use.

You grant Trove a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and promote the submitted material in connection with Trove’s Services, events, and marketing. This license does not transfer ownership. Trove may remove or decline material and is not required to publish any submission.

You must obtain permission from every identifiable person shown or named in a submission and from a parent or legal guardian when required for a minor. You must not submit private information, infringing content, deceptive claims, harassment, unlawful material, or content that creates a safety risk.

## Section 12 — Intellectual Property

The Services and Trove-created trademarks, text, graphics, software, interfaces, designs, photographs, video, audio, compilations, and other content are owned by Trove, its affiliates, or licensors and are protected by applicable intellectual-property laws.

These Terms permit personal, noncommercial use of the Services. Unless Trove gives prior written permission or applicable law permits the use, you must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, scrape, or commercially exploit protected material.

No license is granted except as expressly stated. All rights not expressly granted are reserved. Third-party names, characters, card images, rules, trademarks, and copyrighted materials remain the property of their respective owners.

## Section 13 — Optional Tools and Third-Party Services

The Services may provide access to tools, data, links, or functionality supplied by third parties. Third-party services are provided under their own terms and privacy notices. Trove does not control and is not responsible for independent third-party services, content, availability, security, or transactions.

Before using a third-party service, you must review the terms and privacy practices that apply to it. Use of a third-party service is at your own discretion and risk, subject to rights that cannot legally be waived.

New Trove features and resources are part of the Services and are governed by these Terms unless different terms are disclosed.

## Section 14 — Relationship With Shopify

Trove of Collectibles is powered by Shopify, which enables us to provide the Services. However, sales and purchases made through our store are made directly with Trove of Collectibles. Shopify is not responsible for any aspect of a sale between a customer and Trove, including injury, damage, or loss resulting from purchased products or services. To the extent permitted by law, users release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Trove.

## Section 15 — Privacy

Personal information is handled according to our [Privacy Policy](https://troveofcollectibles.com/policies/privacy-policy), our [Trove Supplemental Privacy Notice](https://troveofcollectibles.com/pages/trove-supplemental-privacy-notice), and applicable Shopify privacy disclosures.

Shopify and other service providers may process information in other countries to operate and improve the Services. Users must review the applicable notices for details concerning collection, processing, disclosures, retention, transfers, and privacy rights.

## Section 16 — Feedback

If you submit ideas, suggestions, proposals, reviews, or other feedback not covered by the publication terms above, you grant Trove a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that feedback for operating, evaluating, improving, and promoting the Services.

You represent that you have all necessary rights, that required compensation or incentives have been disclosed, and that the feedback is lawful and accurate. Trove is not required to maintain unsolicited feedback in confidence, pay compensation, publish it, or respond.

## Section 17 — Errors, Corrections, and Service Changes

The Services may contain errors, inaccuracies, omissions, interruptions, outdated information, or unavailable features. Trove may correct information, update the Services, suspend a feature, and correct or cancel an affected transaction as described in these Terms and as permitted by law.

No website, application, automation, AI, promotional-credit, inventory, pricing, or employee error creates a right to an unintended benefit, invalid transaction, unauthorized credit, unavailable quantity, or ineligible purchase.

## Section 18 — Prohibited Uses and Conduct

You must not use the Services to:

- Violate law, another person’s rights, or these Terms;
- Commit or facilitate fraud, theft, payment abuse, false returns, chargeback abuse, counterfeit sales, or deceptive conduct;
- Harass, threaten, stalk, intimidate, discriminate against, defame, sexually harass, exploit, or abuse an employee, customer, event participant, contractor, or other person;
- Publish or threaten to publish private personal information, home addresses, private contact information, credentials, security details, or other information in a manner intended to harass, intimidate, endanger, or facilitate unwanted contact;
- Impersonate another person or misrepresent identity, authorization, eligibility, ownership, condition, evidence, or the origin of a communication;
- Submit malicious code, unsafe files, spam, unauthorized advertising, or false or misleading information;
- Scrape, crawl, harvest, copy, resell, reverse engineer, overload, interfere with, probe, or bypass any access, rate, purchase, promotion, authentication, security, or technical control;
- Collect or track another person’s information without authorization;
- Use bots or automation to purchase restricted products or gain an unfair advantage;
- Retaliate against an employee or other person for enforcing a policy or reporting misconduct; or
- Engage in conduct that disrupts operations, creates a safety risk, exposes Trove or others to liability, or materially interferes with another person’s use of the Services.

Trove may preserve evidence, restrict communication channels, refuse service, cancel eligible pending transactions, remove content, suspend access, terminate accounts, contact a payment provider, or report suspected unlawful conduct to authorities when reasonably necessary and permitted by law. Trove will not deny service on a basis prohibited by law.

## Section 19 — Suspension and Termination

Trove may suspend or terminate access to all or part of the Services when a user violates these Terms, creates legal or security risk, threatens or abuses others, misuses a promotion or payment process, interferes with operations, or when termination is otherwise reasonably necessary and permitted by law.

Termination does not eliminate amounts lawfully owed or obligations arising before termination. Provisions concerning intellectual property, user submissions, privacy, payment, disputes, disclaimers, liability, indemnification, governing law, and any provision that by its nature continues after termination remain effective.

## Section 20 — Disclaimer of Warranties

Except as expressly stated by Trove or required by law, the Services and informational tools are provided “as is” and “as available.” Trove does not warrant that the Services will be uninterrupted, timely, secure, error-free, complete, or suitable for a particular purpose.

To the fullest extent permitted by law, Trove disclaims implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement. Some jurisdictions do not permit certain disclaimers, so some provisions may not apply to a particular user.

Product warranties provided by a manufacturer remain subject to the manufacturer’s terms. Nothing in this section disclaims a warranty or consumer right that cannot legally be disclaimed.

## Section 21 — Limitation of Liability

To the fullest extent permitted by law, Trove, its owners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, lost data, loss of opportunity, or replacement costs, arising from use of the Services or products obtained through the Services, even if advised of the possibility.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or other liability that applicable law prohibits Trove from limiting.

## Section 22 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Trove, Shopify, and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from your unlawful conduct, infringement of another person’s rights, fraudulent or unauthorized submissions, or material breach of these Terms.

Trove will provide reasonable notice of an indemnified claim when practicable. A failure to provide prompt notice relieves an obligation only to the extent the delay causes material prejudice. Trove may control the defense and settlement, but will not agree to a settlement imposing a nonmonetary obligation on you without your consent, which must not be unreasonably withheld.

## Section 23 — Severability and Waiver

If a provision is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted and the unenforceable portion will be severed. The remaining provisions remain effective.

Failure to enforce a provision is not a waiver. A waiver is effective only when stated in writing by an authorized Trove representative.

## Section 24 — Entire Agreement and Priority of Terms

These Terms and incorporated policies constitute the agreement governing use of the Services and supersede prior communications concerning the same subject.

Specific written terms displayed for a product, event, promotion, preorder, buylist, or service control over these general Terms only for the specific subject and only to the extent of a direct conflict. Mandatory law controls over any conflicting provision.

## Section 25 — Assignment

You must not assign or transfer these Terms or related rights or obligations without Trove’s prior written consent. An unauthorized attempted assignment is void.

Trove may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, financing, or transfer of the Services, subject to applicable law and privacy obligations.

## Section 26 — Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except when mandatory law requires another result.

Subject to mandatory consumer rights and any court with exclusive jurisdiction, disputes must be brought in a state court with jurisdiction in Davis County, Utah, or the applicable federal court serving that location. The parties consent to personal jurisdiction and venue in those courts.

## Section 27 — Changes to These Terms

Trove may update these Terms for operational, legal, security, or service-related reasons. The current version will be posted with an updated date. Trove will provide additional notice and obtain consent when required by applicable law.

Changes do not retroactively eliminate rights or obligations that applicable law prevents Trove from changing. Continued use after an effective update constitutes acceptance when permitted by law.

## Section 28 — Policy Acceptance and Electronic Records

When a policy-acceptance checkbox is displayed, the user must select it before proceeding. Selection confirms agreement to these Terms and the incorporated policies, including order review, preorder allocation, promotional-point eligibility, shipping-claim deadlines, packaging retention, and continuous-opening-video requirements.

Electronic records, confirmations, checkbox records, account records, and communications may be retained as evidence of transactions and policy acceptance, subject to the Privacy Policy and applicable law.
